Publisher’s Note: If one has any grasp of the last 4 decades, an interest in politics, intrigue and corruption, this story contains information about Watergate, Nixon, Hatch, Utah and a host of other individuals and circumstances that has never been told before. It likely will never be equaled in its variety and authenticity again. It is a story told by an investigator that has had unprecedented private and personal access to people and events that have happened in our lifetime. Wayne exposes conduct that is shameful, inappropriate, obscene, unlawful, questionable, complicit and corrupt. He attributes much of this conduct to Hatch, Leahy, Mueller and a number of Utah’s Revered Goodfellas. Of necessity, the only way this story could be told is in the first person. The Swamp was a Puddle until The Scion of Superficiality, Senator Orrin Hatch and his Goodfellas, Slithered into the Swill of it. (We do love alliteration … wonderful words softly savored by the palate’s tender tissues.)

Our “yarn spinning” needs a solid setting.  We’ll get to and expose Hatch soon enough. In the meantime, building solid props is paramount for the production and show that is to follow. The reader’s (your) life is about to be confronted and energized by our characters, narrative and visuals. Put the kiddies to bed and read on. Be warned! All that follows is NOT nice and NOT clean and NOT proper.

From the early 1900s to 1970 there were plenty of “Goodfellas” and their schemes to go around our Nation. However, the flood from puddle to swamp only became a torrent out of control after Watergate and the subsequent fallout. Watergate was the seminal event that exposed an underbelly of insidious, political corruption.  After the Watergate mess, the Goodfellas learned to carefully operate with anonymity and impunity. They learned to “game” the system to the extent that few from their upper echelons ever went to jail again.

Here, we extend the definition, scope and reach of mere mafia murderers to Goodfellas on all sides and even in the middle of the political and social spectrum. Our “Goodfellas” are just as obscene here as were the characters from the movie in its day. Those who would subvert the Rule of Law and Good Governance in service of “self” are no more righteous than Mafia murderers. They are our Goodfellas and Targets.

With no reservation for party or politics, for us the term “Goodfellas” includes Republicans, Democrats, Moderates, Socialists, Leftists, Communists, Klansmen, and anyone. Does the reader get the picture? The picture should be clear that our focus is on the Rule of Law regardless of who subverts it.

We feel a story coming on … a story that is verifiable yet admittedly biased and subjective. Our story requires the repeated use of the “first person.” The writer’s experience and proximity to the events in the story that follows demands a personal telling of it. There is no other way to begin the story and build it logically and accurately to an “Orrin Hatch” introduction, body and conclusion.

In 1970, I became an FBI Agent. My father was beside himself. He was an old timer, a unionist and he hated the FBI. My mother, a Director J. Edgar Hoover worshiper and staunch Southern Baptist, wouldn’t believe that I could ever become an FBI Agent. My churlish adolescent mischief and beer drinking ways hadn’t gone down well with Mother. Suffice it to say, I had been a problem child as far as she and our Pastor were concerned.

The only time Mother visited us in Utah was when I graduated from the University. Personally for her, it was irresistibly compelling to attend my graduation. She would believe only her eyes that I could ever earn a degree … the first in the family to do so. While I was an FBI Agent, she visited us in California only once and that was shortly afterDirector Hoover sent me a letter of commendation and a $150 incentive award.  I had been rewarded for arresting a bank robber. After a Code III chase running red traffic lights as fast as the ole’ Bureau car would go, I lurched into a Watts’ neighborhood and collared the guy and later his driver.

Shortly after I received the award, Mother flew from Salem, Oregon to Los Angeles, got off the airplane and demanded, “Let me see that letter!” She promptly spit on her finger and slopped it across the ink smearing Hoover’s sacred signature. She seemed satisfied with her amateur analysis and reluctantly acknowledged that her wayward son was truly an FBI Agent. Nearly 50 years later, the signature is fading because of the acid in her spit. Some things never change.  Over the years we had come to understand that the literal and metaphorical application of her acidic spit to rub out dirt, apply to children’s scrapes and scratches, polish glasses and silverware was strange evidence of her duty and love.

I’ll admit it Director J. Edgar Hoover scraped the bottom of the barrel when he scooped me up and made an Agent out of me. Somehow, mostly by accident, I concluded my six years of service with honor, success and a number of Director’s letters of commendation to prove it. (Some historyhere andhere.)

As an FBI Agent, I worked Bank Robbery, Kidnapping, Hijacking and some Organized Crime cases in Los Angeles.  During my first year in LA, there were over 250 bank robberies. Yahoo! What an absolutely wonderful merry-go-round that duty was. I enjoyed a heavy caseload, a family of four feisty children, a lovely and dearly beloved wife, a Master’s Degree nearly completed and all the positives any young man of my past, inclination and preference could envision. My life as an FBI Agent was above and beyond the fantasies I had ever conjured as a farm boy, ranch hand, day laborer, logger, Air Force Sergeant and faceless, nondescript nobody.

One early morning on the FBI’s 14th floor of the Federal Building in Los Angeles as I was preparing to go roust a bank robber from the warmth of his cozy digs, my whole being, self and psyche was suddenly shifted from naive to cynic. I had been oblivious to the politics of the day other than to grouse about a thing or two that was happening around the Nation and World. My focus was intensely on family, the FBI, School and other matters close at hand and home. That morning and the event of it set me on a trajectory from which I have never recovered.

The 14th floor was divided into office spaces for supervisors, storage and other work rooms, and the “bullpens.” Our particular “bullpen” housed dozens of agents who were about equally divided between the bank robbery (BR) squads and the organized crime (OC) squads. On that morning in the early 1970s, there were just two of us in the bullpen. I was on the Bank Robbery side and George (that’s what we’ll call him) was on the Organized Crime side of the bullpen. It was 6am in Los Angeles and 9am in Washington, DC. George was on the phone with Washington. As I recall, he was obviously extremely angry about the conversation he’d just terminated.

George finished his conversation with Washington, D.C. and out of character, he came out of his confidential compartment and stomped over to me growling, “They turned off my tap!  They turned off my tap!”  I said nothing just letting him ramble and vent.  The story that he told – as he opened the door and led me into his secret world – was that he had been collecting information from a court ordered wiretap … information that was incriminating of President Richard Nixon’s relationship with Organized Crime and the Teamsters Union.  His conversation with Washington that morning included orders from Attorney General John Mitchell to, “Turn off the tap.” As history records, Mitchell was subsequently indicted, convicted and jailed for committing multiple crimes in the Watergate affair.

We Bank Robbery agents were chasing dumbassed, drugged out, shoot em’ up dregs of society and not much if anything that we did was confidential.On the other hand, Organized Crime Agents worked wiretaps and top echelon criminal informants. Most of what they did was appropriately classified confidential and shared only on a need to know basis.

George’s months of painstaking investigation and reportage had vanished with the stroke of a politically poisoned pen. My own youthfully, naive politics were ravaged that day. The rogue that I am today remains conflicted by cynicism and doubt. The doubt is about the possibility of an equitable Administration of Justice and the Rule of Law and Good Governance in the United States of America.

Here comes another tale clamoring to get out.  It’s an “aside” yet critically important to our title “… ye generation of vipers ….”

The FBI delighted in assisting State and local agencies. Proof of this is in the National Academy for Law Enforcement Officers and decades of training and professional services offered by the Bureau. This is good and works an advantage for all concerned. One such service involves the apprehension of criminals who have fled State and local jurisdictions.  The FBI works Unlawful Flight to Avoid Prosecution cases with vigor. Many of these cases involve criminals wanted for serious and violent crimes. I was the Assistant Senior Resident Agent and as such was tasked with investigations and arrests that involved crimes of violence. I was assigned to arrest Gerald Joseph DeNono a fugitive from Nevada wanted for arson.

A team from our Resident Agency actually arrested DeNono, and I became one of a number of his debriefers. Pausing here to remind the reader, we are focused on “The Swamp was a “puddle” until The Scion of Superficiality Senator Orrin Hatch and his fellow Goodfellas swam into the swill of it.”  Were we not so narrowly focused on Hatch and the Goodfellas, we’d take a walk through one of the most engaging and intriguing of all criminal justice stories … the DeNono story … but not this time. We will, however, connect DeNono preliminarily to this work because he and an amazing document are at the center.

I carefully debriefed DeNono and from then to this very day he trusts me. Some weeks after his arrest, the FBI’s Los Angeles expert in Organized Crime matters took over the debriefings along with attorney James Twitty from the Federal Organized Crime Task Force. Thereafter, an iron curtain of secrecy enshrouded DeNono and the information he was providing. As an aside, we later learned that Twitty went to work for gaming interests in Las Vegas … the same Goodfellas he was supposed to be prosecuting as a Strike Force attorney. According to California records, Twitty was later disbarred.

One event that should be included here involves DeNono’s theft of a priceless “chunk” of pure white quartz containing gold flakes and nuggets embedded throughout.  Now, when I say “chunk,” I mean a basketball sized specimen. I recovered a small handful of the specimen after it had been broken down. I actually held it in my hand and imagined the forces of nature that had created its magnificence. The original,  basketball sized chunk of gold ore was almost as priceless and rare as a Mona Lisa.

DeNono was something of an “outrider.”  He operated in a Las Vegas gang called Diversified Business Developers (DBD) headed by, at that time a sitting judge, the crooked Robert Reed. DBD and Judge Reed assigned DeNono to “off the ore.” The ore had been transported from Grass Valley CA where it was mined to Midland Texas where it was to have been auctioned off. DeNono was tasked to travel to Midland in the Judge’s car and steal the ore.

Mission complete, DeNono and DBD tried to market the ore but it was far too hot! Much like trying to steal and then sell the Mona Lisa, no one was buying it. DeNono took it to the Fazio Organized Crime family in Florida. They didn’t want it.  He took it to Carlos Marcello’s outfit in New Orleans and they didn’t want it. Finally he brought it back to Las Vegas. The gold specimen stayed in the trunk of the Judge’s car until Richard Eugene McClune was given the task to break it down and extract the gold for its monetary value only.

Some time after the above, we arrested DeNono and began the debriefing. In the process and among other crimes, he confessed to an attempted bank burglary naming his accomplice Richard Eugene McClune. We arrested McClune and guess what? He still had a small chunk of the ore in his possession. Based on this, we set out to obtain search warrants for Judge Reed’s car. In doing so, we tried to coordinate with Las Vegas FBI and asked them to serve the warrants and vacuum the car’s trunk. Even before this, we had been thwarted by the Las Vegas FBI in our work to solve crimes identified by DeNono. The response to our request to have the Judge’s trunk vacuumed was, “We don’t have a vacuum cleaner.” After that, any communication with Las Vegas FBI was routed through Headquarters in Washington, D.C. and the Director … the only way we could get a decent response from Nevada

Our history with the Nevada FBI and Attorney General Mitchell’s conduct added to the writer’s angst over the Federal Justice System.

During the time that DeNono was available to us in our co-operative debriefings of him, we were able to identify and help clear a number of criminal cases. Once more we remind the reader that the DeNono story is far too robust to begin here.  Even years after being convicted and sentenced, DeNono was instrumental in the conviction of several well known Organized Crime figures. His story is not yet told in its fullness but we’ll attempt it soon.

All throughout our debriefings of him, DeNono kept hinting about a document that he possessed secretly left in the custody of a trusted associate. He suggested that this document contained critical information of inestimable value sufficient to provide him with leverage in the cases against him. This document became known as “The Las Vegas Ledger.”

The “Las Vegas Ledger” is a binder containing a number of hand posted entries on ledger book pages that reflect financial events and activities between and among Las Vegas gambling, Organized Crime Individuals and crime families, the Teamsters Union and political Goodfellas to include Nixon and the Watergate gang. It’s easy to understand DeNono’s reliance on The Ledger as a possible bargaining tool. The process of submitting “The Ledger” to authorities came later and involved me … one of only two Agents of the Government that DeNono ever really trusted and trusts to this day.

We’ll shift gears slightly now and lightly touch on another small part of the DeNono story that we can tell.
Then we’ll move onward and downward to Orrin Hatch.

All was well until one day after finishing up the preliminary investigation of a bank robbery in the Valley, I was stuck in a traffic jam on the 405 freeway. For nearly an hour, I tried desperately to get to the next bank robbery in Los Angeles. Dispatch was yelling at me over the radio to “get moving” and I was stuck with no choice but to stay stuck.

Having a paranormal event or a “vision” isn’t an experience most folks are too comfortable talking about and neither am I.  That experience became mine in a Los Angeles traffic jam. It was in the form of a simple question and not really visual. A voice in my heart and mind softly asked, “What are you going to say when your Father-in-heaven calls you into a meeting with him and asks, ‘What did you do with your time on Earth my son?’” Am I to report that a large measure of my time was spent in traffic jams?

That night Sheri and I sat down and began plans to return to Utah, resume our lives as educators and raise our children among their grandparents, aunts and uncles, cousins and other kin … plenty of them if you can imagine being related to families in Utah.

In 1976 after graduating with my Master’s Degree from California Lutheran University, I left the FBI to return to Utah and teach school. For the next two years, I taught High School Sweathogs … yes … Sweathogs … I was assigned to teach English to the Football, Soccer, Hockey Players and Cheerleaders. I loved them and do believe, regardless of their conduct from time to time, they loved me. They were a pretty “salty” bunch of kids and I was determined to make an impact on their lives and ability to communicate. We did fairly well in regards to both. I told my classes about DeNono and they all wanted to write to him. He was moved from place to place in the Federal System, yet we chased him down with our letters. His counsel and advice was precisely what many of my rascally students needed and still after more than 30 years they remember his lessons and letters.

The Utah Attorney General’s Office

In 1978, former FBI Agent Ron Todd, who was the Chief Special Agent for the Utah Attorney General recruited me to work Organized Crime, White Collar Crime and Corruption in Government cases with his Division’s Agents. This was an ideal placement for me because of the inequities I had encountered in the Justice System. I believed that I could put Goodfellas from the “suites” in jail for a change and not just the little guys from the streets. I wanted to make a difference in society by sending Goodfellas to jail.

My introduction to the Utah Attorney General’s Criminal Justice Division was somewhat troubling. The other agents were experienced and well educated, but their experience and education was more suited to the Division’s charter than was mine. Several had MBAs and extensive financial crimes investigation experience. I had neither. My forte’ had been crimes of violence and fugitive matters. However, I hit the ground running but in combat boots when in fact the race required track shoes. Were it not for Sid Neslen, I would have fallen out.

Sid Neslen was an old timer … a much beloved “Uncle” to the Division’s agents and relic from the WWII era. He had little or no Criminal Justice experience before becoming an Agent for the Utah Attorney General. However, the skills he did have in abundance were those that I needed most desperately. Sid had been a businessman in Utah for decades. His work at the AG’s office was a hobby job for him. As important as his knowledge of finance and business was, Sid knew the Utah players … all of them … from attorneys to judges to brokers to the perpetual scam artists who cycled through the courts.

I stuck to Sid like glue and am forever grateful for his friendship and mentoring. Sid was the only reason I survived and learned to thrive in the AG’s office. I studied and studied, attended every in-service and seminar I could find, and eventually learned that the simplest course of action was to follow the money. Of course twists and nuances along the way kept me on a perpetual learning curve. Even though I experienced considerable success and was delighted with the mission, I always felt inadequate to the task. Perhaps my feelings of “inadequacy” were like a necessary, never ending dose of humility that kept me centered and on task. No matter the obstacle, I never gave up even in the face of extreme, political resistance.

The Las Vegas Ledger comes to Utah

In the meantime, I continued a correspondence with DeNono and eventually he, trusting no one in the FBI or Strike Force, asked me what he should do with the Las Vegas Ledger. In the interim, DeNono had been sentenced to several life sentences for homicides he had committed or participated in and he was hoping that if he brought it forward, The Ledger would provide him some leverage. I told him that if he wanted to preserve the custody and integrity of The Ledger for himself, he (through his intermediary) should offer to submit four or five pages to the FBI at a time. Those pages could be examined by the FBI Laboratory, returned and then four of five more pages could be submitted.  

That process was followed with exactness until such time as it came to submit the pages mentioning Nixon and the Watergate gang. Those original pages, even though DeNono demanded their return, were never returned by the Bureau. Thankfully, all of the pages were copied by DeNono’s helper. The challenge remaining was to authenticate and verify the information that was in The Ledger. More specifically, we wanted to know who wrote or transcribed it? To this day, that question has never been answered.

The FBI Laboratory could not, did not or would not identify a host of fingerprints found on The Ledger and handwriting thereon with samples from known subjects and suspects.  I say “would not” because of what Dr. Whitehurst has to say about the FBI Lab Scandal.*

The above video gets an asterisk * See also here* and here. * We submit that there is reasonable cause to disbelieve the FBI and its Laboratory’s claim that they could not connect persons to The Ledger. We believe those reasons were political and will be amplified later but suffice it to say … … in the debriefing of a Mafiosi such as DeNono, it’s a “given” that the truth will be mingled with a variety of conflicting statements, loss of memory, misleading, disseminating, deflecting and obfuscating. It’s the Agent’s task to get to the truth and resist the temptation to rant too much about his lies and deflections. Early on we learned that emotionally confronting DeNono served no purpose for us and would have introduced unnecessary conflict shutting him up. When we disbelieved him, we told him so but went on to work on the matters that could be verified. We followed that template and managed to solve crimes and build trust. DeNono promoted several stories about the origins of The Ledger. More important than the origins, the details in The Ledger that could have led to other investigations were timely and critical.

On September 20, 1978, as a Special Agent for the Utah Attorney General, I personally received The Ledger from DeNono’s helper after it had been examined by the FBI. Then began a full court press to authenticate it. DeNono was out of patience with the Justice Department’s foot dragging and was hoping that I and our resources would succeed where others had failed. We were told that The Ledger had been analyzed by the FBI’s lab but were not given the results other than that it was not authenticated which is par for the FBI’s responses in such matters.

The first order of business was to have someone accompany me to the Post Office and witness my receipt of The Ledger. Sid Neslen was my witness. We transported it to the office and logged it into a secure evidence vault. We created a log that tracked The Ledger and recorded the name of anyone who would be reviewing it. On my initial examination of The Ledger, the smoking gun jumped out quickly at date entry “1-5-73.”  Here’s a press report summarizing information about what that entry purports to be.

Payoff to Nixon For Hoffa Pardon Is Alleged Anew November 17, 1979

A recurring allegation that President Nixon received a huge cash payoff for pardoning former Teamster boss Jimmy Hoffa surfaced yesterday in a Phoenix newspaper. The Arizona Republic said it had obtained a 19-page diary that indicated Nixon got a $500,000 payoff for the 1971 pardon of Hoffa. But FBI sources familiar with the case said they felt The Ledger was fabricated. They also noted that the story wasn’t a new development. The document had been turned in about two years ago by an informant named Gerald Denono, they said. Denono was described in the story as a “Mafia hitman.” A similar story about a payoff to Nixon involving Hoffa appeared in Time magazine in 1977. That one said that Hoffa’s successor, Frank Fitzsimmons, paid Nixon $1 million in return for having Hoffa barred from seeking elective office in the union again. Fitzsimmons, and Nixon and his aides consistently denied such allegations. The news story said that the diary showed that some $28 million in slot machine profits was skimmed from Las Vegas casinos in 1972 and 1973. A Jan. 5, 1973, entry apparently referred to Fitzsimmons, reputed underworld figures Allen Dorfman of Chicago and Anthony Provenzano of New Jersey and Nixon aide Charles Colson. According to the Phoenix paper account, that entry said: Fitz OK. Al Dorfman Chi OK. Tony Pro Jersey OK ( $500 — to C.C. (equals) Nix OK).” FBI sources said Denomo gave several conflicting stories about the origins of the diary and isn’t considered a credible witness. “The mob didn’t want Hoffa pardoned.” one source said. “They were perfectly happy with Fitzsimmons.” Hoffa, who was pardoned Dec. 23, 1971, disappeared outside a restaurant in a Detroit suburb on July 30, 1975.

Attorney General Hansen directed me to authenticate The Ledger.

Dr. Daniel H. Bultman, California Department of Justice Organized Crime and Criminal Intelligence Branch was my first stop. I jumped on commercial air and flew The Ledger to him leaving it for his analysis which was conducted and completed efficiently. The Ledger was returned along with his report foundhere and summarized as follows:

Validity  “Although the authorship of The Ledger remains unknown and laboratory tests have so far failed to link the document itself to known organized crime figures, the correlation between The Ledger and previously confirmed intelligence data indicates that it is genuine. The pattern of associations among organized crime figures is accurate, and there is a great deal of inside information, details that could be known only by someone with highly confidential know­ledge of casino operators and their secret deals.

Investigatory Uses  Fingerprint specialists have extracted eighteen usable latent finger­print impressions from The ledger. If a match can be made between one of these impressions and the fingerprints of any persons mentioned in The Ledger, the book can be authenticated and used as evidence. The Ledger reflects a continuous conspiracy during 1972-73 involving money skimmed from casinos and illegally obtained from labor unions that could incriminate some of the most notorious Mafia figures in the nation, along with union officials, casino operators, and assorted racketeers. The result would be a massive prosecution under the RICO statute (Racketeer Influenced and Corrupt Organizations). On a more limited scale, The Ledger, even without scientific authen­tication, can provide clues to many investigations of organized crime activ­ities.”

I then sent copies of The Ledger to the Phoenix Police Department’s senior Organized Crime Analyst Andy Watsick whose report can be found here. Summarizing his conclusions: ”I have read the analysis previously done in this document by Mr. Dan Bultman of the California Department of Justice and I wholly concur with his findings.”

Armed with the analysis and conclusions of two very credible sources, Attorney General Hansen called a meeting of Utah’s Senators and Congressmen and I briefed them about The Ledger and its contents. Those that I recall in attendance were Senator Orrin Hatch, Senator Jake Garn, Congressman Gunn McKay, several others whose names are unrecalled and a delegation from Governor Scott Matheson’s office. Suffice it to say, the re-exposure and besmirching of the Republican Watergate gang didn’t go over well with Hatch but he held his peace in the briefing.

Some time passed, it could have been weeks after the first briefing. The FBI sent two agents out to debunk the validity and authenticity of The Ledger. The only hook that they could possibly hang their hats on was that the FBI could not prove that The Ledger was a fraud. They couldn’t prove a negative or validate the positive even after we went the rounds in the final debate. Thereafter, The Ledger dropped from the office roster of cases and off the Attorney General’s radar. At my request, he authorized my personal re-possession of it and it’s secure today where it rests.

We allege that Senator Orrin Hatch worked behind the scenes to have The Ledger debunked and buried by the FBI. Many of the indicators that follow are persuasive of this allegation. In the 1980s, the Republican Party was on the cusp of returning to power. Resurrecting Watergate crimes would have been toxic for a Republican Reformation and Renaissance.

That was not the end of The Las Vegas Ledger.

Special Agent Bill Roemer * was reportedly the FBI’s most decorated agent of our times. With tongue in cheek and a warm poke in the ribs at Bill, that could have been a report written about him by him. Bill was a robust, rollicking, good natured Notre Dame educated attorney … recognized and rewarded by Director Hoover as the Bureau’s most expert Organized Crime investigator. Bill’s office of assignment was Chicago which, other than Las Vegas, was the very nexus of The Ledger’s events and actors.

As The Ledger story unfolded, Bill became involved and corresponded with me regarding it and DeNono. We became fast friends. Bill was a scrapper by nature and a boxer by experience and inclination … a two fisted no nonsense man of honor and beloved by those he tolerated. He had little or no patience for bullshit … especially the FBI’s variety.

After Bill retired, he consulted and in one matter provided his services and expertise to Penthouse Magazine which was being sued by the La Costa Country Club in California. Everybody knew thatLa Costa was a Mafia bastion,”Mobbed Up” so they say. Penthouse reported it in their magazine resulting in a suit for libel being filed against them by La Costa.  At the time, I had left the Attorney General’s Office and returned to teaching. Bill reached out to me asking that I meet with attorneys from Penthouse and show them The Ledger. There were references to La Costa in it. We arranged a meeting in Salt Lake City for that purpose. The attorneys took good notes and eyed The Ledger longingly but I scowled them down. I’ll shorten this up a bit by saying that Bill went to his grave personally authenticating and publicizing the validity of The Ledger and its investigative lead value.

I am the only Agent in the history of the FBI to have received a letter of commendation from Director Hoover and also a letter of commendation from Hoover’s arch enemy Jack Anderson of The Washington Merry Go Round. news column. Anderson camped on Hoover’s trail 24/7/365 and Hoover loathed him for it. Theletter from Director Hoover * was explained earlier and resulted from my solo high speed chase and apprehension of a bank robber. The letter from Anderson* was the result of work to help publicize The Last Vegas Ledger.

We pause … Wayne L. Wickizer, Special Agent Utah Attorney General 1978-1986, fired for insubordination.

I enjoyed a number of  successes at the Utah Attorney General’s Office. The prize among them was to have successfully investigated and prosecuted Utah’s first Racketeering, Bribery and Anti-trust case using Utah law to do so. Lest I make this sound like some solo triumph, it wasn’t. The team of three plus more get the credit. However, I started the ball rolling and kept at it to the end.

I had been assigned to investigate Utah Power and Light – our major electric utility in the State. Chief Special Agent Ron Todd handed me the assignment memo and apologized for giving me a case that no one to date had been able to “crack.” I made my rounds though Utah’s regulatory agencies, Federal and local criminal investigative agencies and even the press contacts that I had developed … all of them had the same story to tell.  They had been hearing for years of the corruption in Utah Power and Light but nothing had been accomplished to resolve it.

Attorney General Bob Hansen had lost his office to David Wilkinson, a political Goodfella of the first order. It was on Wilkinson’s watch that we obtained our convictions with more work to be done investigating other crimes that were evident from the work we had accomplished already. We wrote a 500 page evidence memorandum detailing a plan to conduct additional  investigations and prosecutions. There were Federal crimes alleged as well as criminal conduct to be addressed at the State and local levels.

Wilkinson rejected our efforts to continue the case in his office. United States Attorney Brent Ward rejected our appeal to involve the Federal Government. I took the matter to the Chief Judge of Utah’s 3rd District. He and the 12 other judges on the 3rd District panel read our memorandum and called me to testify before them. As a result of my testimony and the strength of the evidence presented, the judges called a State Grand Jury. There is a Grand Jury sitting perpetually Federally but calling one to sit at the State level is a rather rare occasion. Attorney General Wilkinson learned of my action and fired me for insubordination. We litigated the matter in Civil Court as an “Unlawful Termination” and we won.  However, winning was losing for me because my criminal justice career was ended.

Basically, they are trying to figure out how to pay off the burglars who were blackmailing them.

On January 14, 2019, Utah’s Deseret News hosted a forum in Washington D.C. to discuss “Integrity and Trust: Lessons from Watergate and Today.” The speakers were Journalist Bob Woodward, Elder D. Todd Christofferson, and Michael Dimock.

Bob Woodward — Woodward and his Washington Post colleague Carl Bernstein won a Pulitzer Prize for breaking the Watergate story in 1973. Woodward won a second Pulitzer in 2003 for his post-9/11 coverage. He has authored 19 best-selling nonfiction books, including “All the President’s Men” (with Bernstein) and “Fear: Trump in the White House.” He currently is an associate editor at The Washington Post.

Elder D. Todd Christofferson — As a law clerk for U.S. District Court Judge John Sirica, he was among the first to hear the Nixon White House tapes. Elder Christofferson left a distinguished legal career in 1993 to become a general authority of The Church of Jesus Christ of Latter-day Saints, where he currently serves as a member of the Quorum of the Twelve Apostles.

Also, Michael Dimock, President of the Pew Research Center — a nonpartisan fact tank that informs the public about the issues, attitudes and trends shaping America and the world — will present research findings about trust in individuals, elected officials and public institutions.

I am reminded of Shakespeare’s Julius Caesar and Brutus’ denials and deflections. Brutus, Senator and self proclaimed champion of the “Greater Good” for Rome, stabbed the hapless Caesar in the back.  Shortly thereafter he alibied, “… not that I loved Caesar less, but that I loved Rome more. “

We realize now who loved us less but pretended to love us more. Orrin Hatch, Brutus for our time, emerged as the political Deus ex Machina. As if from the Bard’s own pen, Hatch is the champion of a counterfeit “Greater Good” and puppet master presiding over the Swamp. Hatch, Cleaner for the Deep State and its Goodfellas, is the price we have paid for our political lethargy, nonchalance and neglect.

What do we really care about here?

We care to confront and expose shameful, inappropriate, obscene, unlawful, questionable, complicit and corrupt conduct. Because we find it unnecessary to meet the rigors of preparing for prosecution, we elect to simply shame. In shaming, the foregoing descriptors of conduct are weighted evenly. In our mind, the Rule of Law and Good Governance is subverted equally as egregiously by shameful, inappropriate, obscene, unlawful, questionable, complicit and corrupt conduct.  For a simple, recent example ….

Senator Kyrsten “the body” Sinema’s dress and demeanor in a Senate context is whorish, boorish, tasteless and shameful.  As such, she has become a distraction from and subverted Good Governance by her freshman display of arrogance, impudence and impertinence.

We will use most often the word “shame” as a descriptor … shame, shameful, shameless et cetera. By doing so, we avoid having to prove our narrative beyond a “reasonable doubt,” prove it with “probable cause,” or even prove it as “reasonable suspicion.” We simply advance an “opinion” about matters writ largely by others that some or another type of conduct alleged is “shameful.” We will then set about to shape and express that opinion. We leave it to the Public and the Law to conclude whether or not the conduct alleged was unlawful or corrupt. In doing so, the burden of proof rests elsewhere.

Orrin Grant Hatch (born March 22, 1934)

Orrin Hatch is an American attorney, songwriter, and politician who served as the United States Senator for Utah for over 40 years. First elected in 1976, he was the longest-serving Republican U.S. Senator in history. Until his retirement in 2019, along with Patrick Leahy from Vermont, he was one of only two sitting U.S. Senators to have served during the presidency of Gerald Ford; he was also one of two remaining Republican U.S. Senators, along with Chuck Grassley from Iowa, to have served during the presidency of Jimmy Carter. Hatch served as either the Chair or ranking minority member of the Senate Judiciary Committee from 1993 to 2005. He previously chaired the Senate Committee on Health, Education, Labor, and Pensions from 1981 to 1987. Hatch also served as Chairman of the Senate Finance Committee. On January 3, 2015, after the 114th United States Congress was sworn in, Hatch became President pro tempore of the Senate. On January 2, 2018, Hatch announced that he would retire from the Senate and that he would not seek re-election in November.

We contend that Hatch, Leahy and Mueller have had their arms around the mechanics of government longer than any others in the history of The United States of America. Perhaps not the longest “serving,” but by virtue of their key roles they have wielded power and maintained control for decades. Collectively, they were Gods ruling their subalterns, factotums, and step’n fetchits dispensing favor and censure at will. However, Hatch, first among equals, is the master Deus ex Machina poised in “theater” to descend, dispense and resolve.

Hereafter, we will concern ourselves primarily with Hatch, his conduct and his fellow Goodfellas.

In BCCI, Hatch got caught with his pants down.

His conduct was shameful, shameless and questionable regarding the Bank of Credit and Commerce International (BCCI). BCCI was accused of money laundering, facilitating terrorism, drug running, and a host of other crimes committed and mixed up with a number of Domestic and International intelligence agencies. BCCI was often characterized as the most corrupt bank in the history of the World … and may still be the front runner mother of all failed banks. In January 1990, the federal judge in a case against the Bank of Credit and Commerce International (BCCI) accepted a 1989 plea bargain offered to the bank by the U.S. Department of Justice. The bank was to pay $15 million in fines and only admit that it had laundered drug money. Afterward, Hatch presented an impassioned defense of the bank in a speech on the Senate floor. It had been largely written for him by the bank’s attorney Robert Altman.

Hatch said, “The case arose from the conduct of a small number of B.C.C.I.’s more than 14,000 employees.” Since 1989, Hatch and his aide, Michael Pillsbury, had been involved in efforts to counter the negative publicity that surrounded the bank. Hatch had also solicited the bank to approve a $10 million loan to a close friend, Mazur Hourani. In 1991, B.C.C.I. was shut down after regulators accused it of one of the biggest international financial frauds in history. Law enforcement officials accused the bank of making bribes throughout the third world to arrange government deposits. Clark Clifford, a former presidential advisor and Defense Secretary, and Altman, his law partner, were charged with taking bribes from B.C.C.I., in exchange for concealing its illegal ownership of First American Bankshares, a Washington holding company which Clifford chaired. Both had denied the charges, which were filed in New York State and Federal courts.[48] In 1992, in a “Report to the Committee on Foreign Relations of the United States Senate,” prepared by committee members, U.S. Senators John Kerry (D-MA) and Hank Brown (R-CO), noted that a key strategy of “BCCI’s successful secret acquisitions of U.S. banks in the face of regulatory suspicion was its aggressive use of a series of prominent Americans,” Clifford amongst them.The relationship with Hourani included the receipt of campaign contributions laundered through his employees, for which Hourani was fined $10,000, as well as his purchase of 1,200 CDs of Hatch’s songs, for which Hatch received $3 to $7 each, and the management of a blind trust for Hatch. These led to a Senate Ethics Committee investigation, by which Hatch was eventually cleared. (We add Toothless Senate Ethics Committee.)

Here we actually see and hear Hatch’s shameless self defense of questionable conduct unbecoming a United States Senator in the matter BCCI.*

Not only Hatch, but there were others on a purported BCCI Bribes List: 108 members of the House of Representatives and 22 U.S. senators. More sinister and shameful than even Hatch’s conduct, we now turn to Robert Mueller.

We allege Mueller was Hatch’s counterpart in the BCCI debacle.

Mueller has been shamed for letting upper echelon Goodfellas in BCCI off the hook. One only has to review the Bribes list to understand why. Were Mueller to have pursued the prosecution of those listed and others at upper echelons, the Government may have been in crisis for a time. However, had he acted as chartered to do so, the metastatic, end stage, political malignancy of our times could have been severed at the cause decades earlier. We believe that it was Mueller’s failure and the systemic failure of a corrupt and inept Justice Department that has brought us to the brink of lawlessness and disaster upon which we are now teetering. We turn now to theHatch Timeline and other evidence of his shame. It is obvious that most questionable, human conduct remains undisclosed and beyond scrutiny. Even much of that which is reported is quickly left behind in the trash heap of history. We merely report what we can find that has been uncovered and reported by others and shape it for effect.

Want to know where Hatch stood on Feb. 22, 1990? The world’s most corrupt bank, Bank of Credit and Commerce international (BCCI), was feeling the heat from about every major investigative and justice entity in the universe. You guessed it. He was standing up and extolling BCCI’s virtues on the floor of the U.S. Senate. All the while, Utah’s “Rent-a-Senator” Hatch was attempting to secure a $10,000,000 (count the zeros please) loan from that same bad-boy bank.

Want to know about the Rev. Sun Myung “Moonie” Moon, founder of the Unification Church and mentor of multiple, simultaneous marriages? He was convicted of having failed to report as personal income $112,000 in interest received on a $1.6 million bank account. Utah’s “Rent-a-Senator” Hatch got wind of this and yes…. He loaded his cannons. He yelled for a pardon. He ranted, he raved and again he rented his good office to those whose interests, inclinations and heritages were a continent away from the United States and Utah. Yep, he sidled up to another good ol’ boy deep “Moon ” pockets bulging with cash, and let it all hang out, for what again?

Our friends from the Democratic Party tell us, “When you sleep with dogs, you get fleas.” They certainly should know. One thing is positive, party makes no difference when Utah’s “Rent-a-Senator”‘ Orrin Hatch is at it again.

TEAMSTER SUIT YIELDS STRANGE NEW BEDFELLOWS: “A government attempt to take control of the Teamsters has dissolved a three-decade marriage of convenience between the nation’s largest union and the Republican Party while forging an unlikely alliance: Michael Dukakis and Sen. Orrin Hatch, R-Utah.

The former chairman of the Utah Board of Pardons says he successfully lobbied Republican Sen. Orrin Hatch to land a Sandy-based company potentially billions of federal dollars, according to a breach of contract lawsuit the man filed against the company.  

Sibbett said he, Robin Riggs, former legal counsel for Gov. Mike Leavitt, and Kevin Howard, outside general counsel for the Utah State Retirement Board and Systems and a former legislative attorney, formed the lobbying group HGR Enterprises to capitalize on their extensive contacts in Utah and Washington, D.C.

The suit states the three were “instrumental in assisting Senator Orrin G. Hatch in sponsoring and drafting of the Adam Walsh Child Safety Act of 2006,” which passed Congress last July. The bill included a “single-source provision that only the TrackerPAL device can satisfy.”

Secure Alert’s TrackerPAL uses GPS and cellular technology to keep track of parolees. It also includes a two-way radio feature that allows a parole officer to communicate with a parolee by voice. Sibbett says in the suit that the language pretty much ensured Secure Alert would get the federal funds, to the tune of $2.5 billion to $2.8 billion over the next five years. Hatch, who is running for re-election this year, declined to comment on his involvement in introducing the “single-source provision” in the Adam Walsh Child Safety Act.

“We will not comment on any part of a pending legal matter,” Hatch spokesman Peter Carr said in a statement. “Congress created these standards to ensure we had what is necessary to truly seek offenders. Everyone involved — Senate and House judiciary staff, outside child protection groups and other people interested in this issue agreed these standards were appropriate. Any company that meets the standards in the law can participate.”   

Hatch’s Democratic opponent Pete Ashdown in this year’s election said the lawsuit shows how Hatch works for special interests and then gets campaign contributions to help him run again. “This is the vicious cycle of money in politics that I am fighting against,” Ashdown said.

Norman, a convicted swindler, need not have spent the last two decades on the lam if he had merely listened to him as his lawyer 23 years ago. “I could have won that case” on appeal, says Hatch, who was hired by Norman a few days before he was sentenced March 13, 1973, to two years in prison for misappropriation of funds. XanGo’s juice did not exist the last time Sen. Orrin Hatch ran for his Senate seat, but now as the Utah Republican prepares to win his sixth term, the Utah County nutritional drink company has become the top contributor to his campaign — and even added a member to his re-election team. Xango, LLC, has been the top contributor to the political campaign of Utah Senator Orrin Hatch, contributing $47,200 in 2008 and $46,700 in 2006, according to the Center for Responsive Politics.

Time to Define … “Corruption” vs. “Co-option”

We’ve a fair, working grasp of the term “Corruption.” What of “Co-option?” Orrin Hatch has insinuated himself into the Utah fabric even more deeply than merely under the skin … he’s gone below the cellular level and penetrated into the DNA of Utah’s elite Goodfellas and their institutions. He has co-opted these same individuals and institutions. We shall see how he has done so as the story continues to unfold. The definition that readily applies to Hatch’s method is, “If you co-opt someone, you persuade them to help or support you.” Hatch has managed to have his way as Grand Master of the Soft Power of co-option.

Wiki says that“Soft power is the ability to attract and co-opt, rather than coerce (hard power). Soft power is the ability to shape the preferences of others through appeal and attraction. A defining feature of soft power is that it is non-coercive; the currency of soft power is culture, political values, and foreign policies. Recently, the term has also been used in changing and influencing social and public opinion through relatively less transparent channels and lobbying through powerful political and non-political organizations. In 2012, Joseph Nye of Harvard University explained that with soft power, “the best propaganda is not propaganda”, further explaining that during the Information Age, “credibility is the scarcest resource.”

In other words, Hatch slithers up like a snake in the grass and before long sets about the business of co-opting.  All the while his unwitting victims are mesmerized by the aura of his powers, influence and Senatorship.

Hatch was the principal author of the DSHEA. Fast forward seventeen years, and these days any time the Obama Administration tries to write rules to regulate supplements more strictly, Orrin Hatch is there to do his damnedest to block them. Because Hatch is a very senior (and therefore powerful) Senator, he nearly always succeeds. Indeed, as the NYT article points out, the relationship between Hatch and Utah’s massive supplement industry (has) been a hugely mutually beneficial one, and the article also describes just how incestuous it has been as well. First of all, there’s (sic there are) an enormous amount of campaign contributions that Hatch garners every election cycle from supplement manufacturers, but the relationship goes so much more deeply than that. “Shades of Solyndra – As it turned out, the actual results did indeed differ – very significantly – from Raser’s oh-so-rosy “forward-looking statements.” The Hatch Plant has never come close to producing the 11 megawatts it so optimistically (some say fraudulently) projected, and has actually put out a more anemic 5-7 megawatts. Nevertheless, Raser was showered with federal monies. A company press release for February 17, 2010, announced that the company had just been awarded a $33 million U.S. Treasury grant, long after it should have been obvious that Raser was on the ropes.

The press release states that the generous $33million gift from the taxpayers “is provided by the U.S. Treasury Department under the Section 1603 renewable energy grant program created by the American Recovery and Reinvestment Act of 2009. Raser should receive the funds within five business days.”

A little over a year later Raser would be filing for bankruptcy. A Bloomberg article for May 4, 2011 states:

Raser Technologies Inc. (RZTI), the owner of a six-megawatt geothermal electric generating plant in Utah, filed a Chapter 11 petition on April 29 in Delaware and received interim approval yesterday for a $750,000 loan…. The petition listed assets of $41.8 million and debt totaling $107.8 million. The company had revenue of $4.25 million in 2010, resulting in a $71.9 million operating loss. The net loss last year was $101.8 million.

Lobbying ties (From Wikipedia): Hatch’s son Scott Hatch was formerly a partner and registered lobbyist at Walker, Martin & Hatch LLC, a Washington lobbying firm. The firm was formed in 2001 with Jack Martin, a staff aide to Hatch for six years, and H. Laird Walker, described as a close associate of the senator. In March 2003, the Los Angeles Times reported that the firm was formed with Hatch’s personal encouragement and that he saw no conflict of interest in working on issues that involved his son’s clients. In 2009, the Washington Times reported that Hatch said “My son, Scott, does not lobby me or anyone in my office”

In March 2009, the Washington Times reported that the pharmaceutical industry, which has benefited from Hatch’s legislative efforts, had previously unreported connections to Hatch. In 2007, five pharmaceutical companies and the industry’s main trade association, Pharmaceutical Research and Manufacturers of America (PhRMA), donated $172,500 to the Utah Families Foundation – a charitable foundation which Hatch helped start in the 1990s and has continued to support since. Walker, Martin & Hatch LLC was paid $120,000 by PhRMA in 2007 to lobby Congress on pending U.S. Food and Drug Administration legislation.

Why has Orrin Hatch endorsed a plaintiff in an unusually prolonged federal lawsuit? Why are two of Hatch’s Federal Judge Protégées sitting in judgement over the defendants in that lawsuit? How could the plaintiff be so lucky and the defendants be more overwhelmed by Hatch and his Judges?

Hatch and Janice Kapp Perry wrote and sang  a host of sweet little songs like “Heal our Land.” These were songs that while designed to touch hearts and souls perpetually paved the way for Hatch, with his  sticky fingers, to pick a lot a’ pockets and collect a lot a’ votes. Unmatched propagandist and Scion of Superficiality, Master Hatch danced across the Mormon landscape and society like Puppeteer Edgar Bergen danced Charlie McCarthy and Mortimer Snerd on his knees.

Enough, enough, enough … too much … search away to your heart’s content … you know the drill!  Most of the foregoing were published during this decade. Imagine what must have transpired in the 30 years prior? We believe the point is made.

However, there’s another important aspect in all of this to consider and that is Hatch’s nefarious relationship with and unconscionable hold over Utah leaders and voters.

Thanks in large measure to Hatch and his gaggle of Utah’s Goodfellas, the current administration of government in Utah is the most scandal ridden, shameful and corrupt in our history.*

“Utah “Goodfellas” are much like “The Gang that Couldn’t Shoot Straight”. They are stumbling, bumbling, wannabe’ pretenders … little oligarchs … an unimpeded power elite enjoying a bottomless cornucopia of unprotected spoils … an aberrant, arrogant progeny of a fractured political system.  They are conceived, nurtured and operate far removed from the original intent of the framers and founders of this Nation.  They have subverted the “Rule of Law” and ravaged Benjamin Franklin’s vision and proposition that we could enjoy a “… republic if we could keep it.” The Goodfellas have infiltrated, permeated and presumed the right to manipulate every aspect of business, military, industry, finance, education , entertainment, law and religion in Utah.  And … as a result of their control over financing our election processes and our own history of slavish submission … we are relegated to choosing between the horrible and the despicable at the ballot box.  Finally, were it not for political interference, influence, compromise, and corruption … Utah and Federal Investigators, Prosecutors and Judges would/could have more effectively and efficiently pursued the investigations, prosecutions and convictions of these, our very own, home grown, Utah Goodfellas. “We have met the enemy and they are us!” Walt Kelly & Pogo”

Hatch is still upright and on top of the grass, can make it to the chair, and hasn’t crossed the Great Divide … yet. Why then are the Utah Goodfellas, including Scott Anderson, president and CEO of Zions Bank, and many others from over the years, bent on eulogizing, canonizing, beatifying, and sanctifying Hatch in the flesh and doing so regularly with measured and clever, artful precision and impunity?

In our experience, there are only three plausible, reasonable, and logical explanations why anyone would stump for Hatch. 1-Can’t read and too damn dumb to tie their shoes, 2-Complicit in Hatch’s hypocrisy and/or cooperating in/with Hatch’s scandalous, reprehensible, shameful or corrupt conduct, or 3-Co-opted by Hatch in some scheme or another.

For obvious reasons, we rule out #1 completely.

Complicit = Involved with others in an illegal activity or wrongdoing. We would add, complicit in shaping and communicating propaganda that formulates and/or creates Cognitive Dissonance, Distortion, Perception Management, Mind Manipulation, and Destabilization. They, the masters (Goodfellas) of these “Black Arts,” with “malice aforethought” and intent or even unwittingly have subverted the rule of law and good governance. If “complicit” is to be believed, then the foregoing Goodfellas are in it up to their bippies. They, with access to a co-opted and compromised media that they control, can float Happy News with impunity and abandon … or even unwittingly do so if that is the case.

Co-opted and Compromised Individuals or Entities= Those engaged within Hatch’s sphere of influence by virtue of the fact that he has dug the dirt or piled the favors on them. They may have, in a variety of ways, found themselves under his influence and control and/or unwittingly become Goodfellas.

The Information Wars are hot and perpetual in Utah as the Happy New s Beat drums on and on unimpeded by The Rule of Law and Good Governance 24/7/365.

All of the foregoing are but the tip of the iceberg. The full impact of Hatch’s shameful, inappropriate, obscene, unlawful, questionable, complicit and corrupt conduct will never be fully exposed and understood.

Finally … Senator Orrin G. Hatch, Chairman of The Senate Committee on Finance 2015-2018…. Where were your endless hearings?

Where is your outrage over … $21 trillion missing … $21,000,000,000,000 missing of our Nation’s vitality and wealth?

Chairman Hatch, the money is missing!  The Pentagon spent $21 trillion unaccounted-for dollars between 1998 and 2015 on your watch. Not to mention the priceless blood of our young soldiers, sailors and airmen unnecessarily spilt in the wake of the application of these trillions. In the least, please write and sing a little “ditty” for us Orrin … something martial that the troops can sing as they fight for your military industrial complex.

Could Orrin Hatch, Patrick Leahy and Robert Mueller have ebbed the flow, turned the tide, or plugged up a deluge of dollars into this figurative, cosmic, financial black hole? Yes … but the sadly tragic glimmer of hope implied by “could’ve, would’ve, should’ve” is light years from the reality of their cowardly, shameful, complicite and self serving performances.
