Louisiana House Votes Unanimously To Ban Dismemberment Abortions

Here in Utah, we have a kinder and gentle approach to abortion: Our State requires anethesia for the women having the abortion in the theory that the defenseless unborn might feel pain as it is ripped apart. An eagle feather or broken shell has more protection than an unborn child. Is this insanity the standard we want Utah to be known by?

Sen. Curt Bramble, R- Provo, who is facing a primary challenge by Chris Herrod, believes that this makes sense because convicts and animals facing death receive anesthetics.

“We go to extraordinary lengths in Utah to prevent the pain of an individual sentenced to death,” Bramble said in USA Today. “With euthanasia, we make every effort to not inflict pain on that animal….(mandating anesthesia) it is consistent with other policies we have in the state of Utah.”

To put this in perspective, In America, a person can be criminally prosecuted for disturbing in any way an eagles nest, even a feather or broken egg-shell. From the Eagle Protection Act: Shall not “take, possess, sell, [], purchase or barter, transport, export or import, at any time or any manner, any bald eagle … [or any golden eagle], alive or dead, or any part, nest, or egg thereof.” The penalty for taking a broken egg shell or a lost eagle feather may include “a maximum of two years imprisonment and $250,000 fine for a felony conviction and six months imprisonment or $5,000 fine for a misdemeanor conviction. Fines double if the violator is an organization rather than an individual.”

Apparently our leglislature and Governor place more value on a feather or a piece of a shell then they do an unborn child. – EW

The Louisiana House voted unanimously Thursday to ban dismemberment abortions and voted 75-1 to ban women from getting an abortion because the fetus has a genetic abnormality such as Down syndrome.

The dismemberment bill would ban the abortion method, commonly used in the second trimester, in which the abortionist uses a metal tool to pull the living fetus out of the womb piece by piece. No one voiced opposition to the bill on the House floor and there was no debate, reported the Associated Press. All 83 representatives present, including 25 Democrats and two Independents voted to pass the bill.

“The fetus in many cases dies just as an adult would,” Republican Rep. Mike Johnson, who sponsored the bill and is running for Congress, told a USA Today affiliate. “It bleeds to death as it is torn limb from limb. There are many who say this is the preferred method not because it better but because it is cheaper.”

Here is how the bill defines dismemberment:

‘Dismemberment abortion’ means, with the purpose of causing the death of an unborn child, to purposely dismember a living unborn child and extract him or her one piece at a time from the uterus through use of clamps, grasping forceps, tongs, scissors, or a similar instrument that, through the convergence of two rigid levers, slices, crushes, or grasps a portion of the unborn child’s body to cut or rip it off or apart.

Pro-abortion activists say the bill would criminalize the “safest” method of abortion for women in their second trimester. State courts have blocked similar laws in Kansas and Oklahoma.

The second bill bans any abortion procedure that is undertaken because the unborn child has a genetic defect, including but not limited to: Down syndrome, any physical disfigurement, dwarfism, albinism, and any other type of intellectual or mental or physical disability. Twenty-one Democrats joined 52 Republicans to pass the bill, over the objection of one Democrat.

Persons found guilty of violating either bill face fines or imprisonment, and violation of the either bill is grounds for civil suit from the women or biological fathers of the aborted fetuses in such cases. Both bills are headed to the Republican-controlled Louisiana Senate.

The House also voted Wednesday to cut off state funds to Planned Parenthood abortion clinics.

Restrictions on Abortion in Utah

In Utah, the following restrictions on abortion were in effect as of December 1, 2015:

  • A woman must receive state-directed counseling that includes information designed to discourage her from having an abortion and then wait 72 hours before the procedure is provided. Counseling must be provided in person and must take place before the waiting period begins, thereby necessitating two separate trips to the facility.
  • Abortion is covered in private insurance policies only in cases of life endangerment, rape, incest, when her health is severely compromised or in cases of fetal impairment.
  • Health plans that will be offered in the state’s health exchange under the Affordable Care Act can only cover abortion in cases when the woman’s life is endangered, her health is severely compromised, fetal impairment, rape or incest.
  • Abortion is covered in insurance policies for public employees only in cases of life endangerment, when her health is severely compromised, fetal impairment, rape or incest.
  • The parent of a minor must consent and be notified before an abortion is provided.
  • Public funding is available for abortion only in cases of life endangerment, rape, incest or when necessary to prevent long-lasting damage to the woman’s physical health.
