Constitutional Scholars Issue Statement on Trump “Muslim Ban”

Despite claims to the contrary, GOP presidential candidate Donald Trump’s proposed ban on Muslim immigration possesses constitutional merit, meaning it would be perfectly legal for him to implement it, constitutional scholars say.
Speaking with Breitbart, George Washington University Law School Professor John Banzhaf pointed to Title VIII, Section 1182 of the United States Code, which explicitly states that the president may “suspend entry” if “the entry of any aliens or any class of aliens into the United States would be detrimental to the interests of the United States.”
“So, on that ground, very clearly it’s constitutional,” Banzhaf remarked, then switching his focus to affirmative action, a similarly veined policy that allows colleges to discriminate on the basis of race so as to promote diversity…. read more here
